2. Acceptance of These Terms
By downloading, installing, accessing, or using AirPulse, you agree to these Terms of Use.
If you do not agree to these Terms, you must not use AirPulse.
3. Description of the App
AirPulse is an iOS application designed to display heart rate information using Apple HealthKit and Apple's workout-related frameworks. The app includes features for Live Activities, widget-related iOS surfaces, location-based tracking filters, optional session location histories, device selection, tags, insights, audio feedback, local notifications, iCloud backup and restore, local settings storage, shortcuts, and optional Pro features.
Depending on the current app version and App Store configuration, AirPulse may offer App Store based purchase or restore flows for optional Pro access and voluntary support purchases. AirPulse does not include user accounts or a developer-operated backend service in the current implementation.
4. License
Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to use AirPulse for personal and lawful use on compatible Apple devices.
All rights not expressly granted remain reserved.
These Terms do not limit any mandatory consumer rights that cannot be waived under applicable law.
5. Health and Safety Notice
AirPulse is a consumer software application for displaying pulse-related information. It is not medical advice, not a medical device, not a substitute for professional healthcare, and not an emergency service.
You must not rely on AirPulse for diagnosis, treatment, medical monitoring, or emergency decision-making. If you believe you may have a medical emergency, contact emergency services or a qualified medical professional immediately.
Heart rate values, insights, zones, audio cues, and maps may be delayed, incomplete, inaccurate, unavailable, or affected by Apple frameworks, device state, sensor behavior, permissions, connectivity, or your environment.
6. Permissions and Platform Dependencies
Important app functions depend on Apple permissions, platform features, and system behavior, including HealthKit, workout sessions, location access, notifications, Bluetooth audio routing, Live Activities, widgets, App Intents, Siri, shortcuts, iCloud, StoreKit, and Apple Maps related services.
If you deny, restrict, or revoke permissions, or if Apple platform behavior changes, some app functions may be limited or unavailable.
7. Purchases, Subscriptions, and Support Purchases
Optional Pro features may be offered through Apple App Store in-app purchases, subscriptions, lifetime purchases, restore flows, or other StoreKit-supported product types.
Subscriptions, if offered, are managed through your Apple ID and may renew according to Apple's App Store terms and the product information shown at purchase time. You can manage or cancel subscriptions through Apple.
Voluntary support purchases, if offered, are intended to support continued development and may not unlock additional features unless expressly stated in the purchase screen.
Prices, availability, trials, taxes, refunds, cancellation options, and billing are handled by Apple and may vary by country or region.
8. User Responsibilities
You are responsible for:
- using AirPulse only in compliance with applicable law;
- reviewing and managing your Health, location, iCloud, StoreKit, and notification permissions;
- deciding whether to enable Live Activities, widgets, shortcuts, audio feedback, location history, and notifications, and managing your iCloud account, storage, and backup availability;
- understanding that pulse-related or operational information may appear on your device screen or in audio output when certain features are enabled;
- verifying that the app and your connected devices are suitable for your own intended use;
- keeping your own backups if you rely on session history or exported data.
9. Prohibited Use
You must not:
- use AirPulse in violation of law or third-party rights;
- use AirPulse for medical diagnosis, emergency response, or safety-critical monitoring;
- interfere with, disrupt, or misuse the app or its technical operation;
- reverse engineer, decompile, or modify the app except where mandatory law permits it;
- misuse purchases, entitlements, restore flows, feedback forms, or support contact channels;
- use the app in a misleading, unsafe, or abusive manner.
10. Availability and Technical Limitations
AirPulse depends on Apple frameworks and runtime conditions that are outside the provider's control. This includes, among other things:
- HealthKit permissions and availability;
- workout-session behavior;
- Bluetooth route availability;
- Live Activity authorization and display behavior;
- StoreKit purchase availability and transaction behavior;
- iCloud availability, quota, sync timing, and backup state;
- widget, App Intent, Siri, and shortcut execution behavior;
- notification delivery behavior;
- location availability and background execution rules;
- Apple Maps related services.
For that reason, AirPulse may not always be available without interruption, and certain features may not work in every situation on every device, or in every device state.
11. Notifications, Live Activities, Widgets, Shortcuts, and Audio Feedback
AirPulse may offer optional local notifications and may display information through Live Activities, widgets, shortcuts, Siri/App Intent surfaces, and related integrations.
If you enable these features, you understand that pulse-related or operational information may be shown on Apple-controlled system surfaces such as the Lock Screen, Dynamic Island, widget areas, or other system interfaces.
If you enable audio feedback, you understand that heart rate zone or limit information may be played through your selected audio route and may be audible according to your device and audio settings.
12. Backups, Export, Import, and Data Loss
AirPulse stores session-related data locally and supports iCloud backup/restore, export, import, or share functions for session-related data.
If iCloud is available for your Apple Account, session-related backup data may be stored through Apple's iCloud infrastructure. That iCloud storage is governed by Apple's applicable iCloud terms, Apple's Privacy Policy, and Apple's iCloud data security practices.
These features depend on device storage, iCloud availability, Apple frameworks, file access, and user actions. You are responsible for checking that backups, exports, and imports meet your needs before relying on them.
No guarantee is given that any backup, export, import, sync, or restore operation will always be available, complete, current, or error-free.
13. Third-Party Services
AirPulse uses Apple-provided frameworks and services for certain app functions. If you use Apple Health, Apple Maps related features, iCloud, StoreKit, Live Activities, widgets, Siri, shortcuts, iOS notification services, App Store review flows, or App Store purchase flows, your use of those services is also subject to Apple's applicable terms and privacy policies.
If you open legal documents, App Store pages, email links, or feedback forms from inside the app or website, AirPulse may open an external website, mail client, App Store surface, or third-party form.
14. Privacy
Your use of AirPulse is also subject to the AirPulse Privacy Policy.
15. Disclaimer of Warranties
To the maximum extent permitted by applicable law, AirPulse is provided on an as is and as available basis.
No warranty is given that the app will always be available, uninterrupted, error-free, accurate for any particular purpose, or suitable for any medical, professional, athletic, safety-critical, or emergency use.
Any warranties that cannot legally be excluded remain unaffected.
16. Limitation of Liability
To the maximum extent permitted by applicable law, the provider will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, loss of profits, loss of goodwill, business interruption, loss of backup data, failed sync, failed purchases, or decisions made in reliance on app output.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law, including liability for intent, gross negligence, injury to life, body, or health, or mandatory consumer protection rights.
17. Changes, Suspension, and Termination
The provider may modify, update, suspend, or discontinue AirPulse or any of its features at any time, subject to applicable law.
These Terms apply for as long as you use the app. They end when you stop using AirPulse and remove it from your device, except for provisions that are intended to survive termination.
