2. Acceptance of These Terms
By downloading, installing, accessing, or using AirPulse, you agree to these Terms of Use.
If you do not agree to these Terms, you must not use AirPulse.
3. Description of the App
AirPulse is an iOS application designed to display heart rate information using Apple HealthKit and Apple's workout-related frameworks. The app also includes features for Live Activities, location-based tracking filters, device selection, local notifications, local settings storage, and optional Pro features.
Depending on the current app version and App Store configuration, AirPulse may also offer App Store based purchase or restore flows for optional Pro access. AirPulse does not include user accounts or a developer-operated backend service.
4. License
Subject to these Terms, you are granted a limited, non-exclusive, non-transferable, revocable license to use AirPulse for personal and lawful use on compatible Apple devices.
All rights not expressly granted remain reserved.
These Terms do not limit any mandatory consumer rights that cannot be waived under applicable law.
5. Health and Safety Notice
AirPulse is a consumer software application for displaying pulse-related information. It is not medical advice, not a substitute for professional healthcare, and not an emergency service.
You must not rely on AirPulse for diagnosis, treatment, or emergency decision-making. If you believe you may have a medical emergency, contact emergency services or a qualified medical professional immediately.
6. Permissions and Platform Dependencies
Important app functions depend on Apple permissions, platform features, and system behavior, including HealthKit, workout sessions, location access, notifications, Bluetooth audio routing, Live Activities, shortcuts, and Apple Maps related services.
If you deny, restrict, or revoke permissions, or if Apple platform behavior changes, some app functions may be limited or unavailable.
7. User Responsibilities
You are responsible for:
- using AirPulse only in compliance with applicable law;
- reviewing and managing your Health, location, and notification permissions;
- deciding whether to enable Live Activities, shortcuts, and notifications;
- understanding that pulse-related information may appear on your device screen when certain features are enabled; and
- verifying that the app and your connected devices are suitable for your own intended use.
8. Prohibited Use
You must not:
- use AirPulse in violation of law or third-party rights;
- interfere with, disrupt, or misuse the app or its technical operation;
- reverse engineer, decompile, or modify the app except where mandatory law permits it; or
- use the app in a misleading, unsafe, or abusive manner.
9. Availability and Technical Limitations
AirPulse depends on Apple frameworks and runtime conditions that are outside the provider's control. This includes, among other things:
- HealthKit permissions and availability;
- workout-session behavior;
- Bluetooth route availability;
- Live Activity authorization and display behavior;
- App Store purchase availability and transaction behavior, when optional Pro features are used;
- shortcut execution behavior;
- location availability; and
- Apple Maps related services.
For that reason, AirPulse may not always be available without interruption, and certain features may not work in every situation or on every device state.
10. Notifications, Live Activities, and Shortcut Features
AirPulse may offer optional local notifications and may display information through Live Activities and shortcut-related integrations.
If you enable these features, you understand that pulse-related or operational information may be shown on Apple-controlled system surfaces such as the Lock Screen, Dynamic Island, or other system interfaces.
11. Third-Party Services
AirPulse uses Apple-provided frameworks and services for certain app functions. If you use Apple Health, Apple Maps related features, Live Activities, shortcuts, iOS notification services, or App Store / StoreKit purchase flows, your use of those services is also subject to Apple's applicable terms and privacy policies.
If you open legal documents from inside the app, AirPulse may open an external website URL.
12. Privacy
Your use of AirPulse is also subject to the AirPulse Privacy Policy.
13. Disclaimer of Warranties
To the maximum extent permitted by applicable law, AirPulse is provided on an as is and as available basis.
No warranty is given that the app will always be available, uninterrupted, error-free, accurate for any particular purpose, or suitable for any medical, professional, or emergency use.
Any warranties that cannot legally be excluded remain unaffected.
14. Limitation of Liability
To the maximum extent permitted by applicable law, the provider will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, loss of profits, loss of goodwill, business interruption, or decisions made in reliance on app output.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.
15. Suspension, Changes, and Termination
The provider may modify, update, suspend, or discontinue AirPulse or any of its features at any time, subject to applicable law.
These Terms apply for as long as you use the app. They end when you stop using AirPulse and remove it from your device, except for provisions that are intended to survive termination.
